Terms of Service

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of the Service

Face Swap Video AI is an entertainment and creative tool that uses artificial intelligence to swap, blend, and transform faces in user-provided photos and videos. The Service is provided for lawful, personal, and creative use only.

3. Acceptable Use and Consent

You are solely responsible for the content you upload, create, and share. You agree to only upload or use images and videos of yourself, or of individuals from whom you have obtained clear, informed, and verifiable consent to use their likeness.

You agree NOT to use the Service to: create or distribute sexual, pornographic, or sexually suggestive content, including any content depicting minors; impersonate, defame, harass, threaten, defraud, or mislead any person; create deepfakes intended to deceive, manipulate elections, or spread misinformation; depict any identifiable individual without consent; infringe any intellectual property, privacy, or publicity rights; violate any law; or attempt to reverse engineer, scrape, or interfere with the Service.

We reserve the right to remove content, suspend or terminate accounts, and report unlawful activity to authorities at our sole discretion.

4. User Content and License

You retain ownership of the content you upload. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely to operate and provide the Service to you (for example, to generate your requested face swap). We do not claim ownership of your outputs.

You represent that you have all rights, consents, and permissions necessary for your content and its use within the Service.

5. AI-Generated Content

Results are generated by automated AI systems and may be imperfect, unexpected, or inaccurate. You are responsible for how you use any output. You must not present AI-generated content as authentic where doing so would be deceptive or unlawful.

6. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@faceswap-video.com of any unauthorized use.

7. Subscriptions, Purchases, and Refunds

The Service may offer paid features, subscriptions, or in-app purchases. Purchases made through the Apple App Store or Google Play are processed by Apple or Google and are subject to their terms.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Manage or cancel subscriptions through your App Store or Google Play account settings. Except where required by law or store policy, payments are non-refundable; app-store refund requests must be directed to Apple or Google.

8. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding user content), is owned by the operator of Face Swap Video AI and protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for its intended purpose.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information, including how we handle images and any biometric-related data.

Facial images you upload are used only as input to generate the face-swap output you request. We do not use face data to identify or authenticate you, and we do not create persistent biometric templates for identity recognition. Uploaded source images are retained only as long as needed to provide the Service and are automatically deleted within 30 days at the latest.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50.

12. Indemnification

You agree to indemnify and hold harmless the operator and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or any law or third-party right.

13. Termination

We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or conduct we believe is harmful. You may stop using the Service at any time.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Face Swap Video AI is established, without regard to conflict-of-law principles.
